Terms of use
These terms are an agreement between you and Nivaani Labs Inc. ("we", "us") about using Nivaa Nest. By creating an account or using the app you agree to them. If you don't agree, please don't use the app.
Who can use Nivaa Nest
Accounts must be created by an adult (18 or older, or the age of majority where you live) who is the parent or guardian of the children using the app, or has their permission. You're responsible for your account and for activity in it.
Free stories
Some stories in every series are free. The number of free stories, and which ones, may change over time.
Subscriptions
- Nivaa Nest Plus unlocks every story in every series for your household. It's offered monthly or yearly at the price shown in the app before you buy, which may vary by country.
- Payment is charged to your Apple ID or Google Play account when you confirm the purchase.
- Automatic renewal: subscriptions renew automatically at the end of each period unless you turn off auto-renew at least 24 hours before the period ends. You can manage or cancel in your Apple or Google account settings.
- Free trial: if a free trial is offered, you won't be charged until it ends. Cancel at least 24 hours before the trial ends to avoid being charged. Any unused part of a trial is forfeited when you buy a subscription.
- Refunds are handled by Apple or Google under their policies.
- If we change the price, Apple or Google will notify you as required before it applies.
Invite a family
You can invite other families with your personal invite link. When an invited family creates an account through your link and their child listens to a story, we unlock additional stories for your household as described in the app. Invites must be sent to real families who choose to join; creating accounts to earn rewards, or other misuse, isn't allowed, and we may remove rewards earned that way. We may change or end the invite program at any time; the current terms are always shown in the app, and stories you've already unlocked stay unlocked unless they were earned through misuse.
Your use of the app
Nivaa Nest is for personal, non-commercial family use. Please don't copy, record, redistribute or resell stories, try to get around the subscription or free-story limits, or interfere with the service.
Our content
Stories, audio, characters, artwork and the app are owned by Nivaani Labs Inc. or our licensors and are protected by law. We give you a personal, non-transferable licence to listen to them in the app while you have access.
Changes to the service
We regularly add stories and may change or remove features or content. We may suspend or close accounts that break these terms.
Disclaimers
We work hard to keep Nivaa Nest available and working well, but the app is provided "as is" and "as available", without warranties of any kind to the extent the law allows.
Limitation of liability
To the extent the law allows, Nivaani Labs Inc. isn't liable for indirect, incidental or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.
Apple App Store
If you got the app from the Apple App Store, these terms are between you and us, not Apple. Apple's standard Licensed Application End User License Agreement also applies, and Apple has no obligation to provide support for the app.
Governing law
These terms are governed by the laws of the State of Delaware, USA, except where the law of your country requires otherwise.
Changes to these terms
We may update these terms. We'll update the date above, and for significant changes we'll let you know in the app or by email. Continuing to use the app means you accept the updated terms.
